PLEASE READ THE FOLLOWING TERMS OF SERVICE RELATING TO YOUR USE OF THE openDoctor WEBSITE. THESE TERMS OF SERVICE GOVERN YOUR USE OF THE openDoctor WEBSITE AND ALL SERVICES OFFERED THROUGH THE WEBSITE.
These Terms of Service ("TOS") apply to all users of the openDoctor website (the "Site"). The term "Site" as it is used in these TOS includes access via any device.
BY USING THE SITE, AND/OR BY REGISTERING WITH US, YOU SIGNIFY THAT YOU AGREE TO THESE TERMS OF SERVICE, including that you consent to the information practices disclosed in our Privacy Policy, which is incorporated herein by reference, and that you consent to resolve in the State of New York any dispute that you may have with us, or the Site. openDoctor reserves the right to update or change these TOS at any time by posting the most current version of the TOS on the Site. Your continued use of the Site after we post any changes to the TOS signifies your agreement to any such changes. If you do not agree to these TOS, you must discontinue using the Site and if applicable terminate your account with openDoctor. This Site is owned and operated by openDoctors 247 , Inc , d/b/a openDoctor. All references to openDoctor herein shall be deemed to include openDoctors 247 , Inc.
Registering as a Member
You do not have to be an openDoctor member to use this Site. Some of what's on the Site is viewable without registering with us, but to actively participate or store your information, you must register as a member and authorize the use and disclosure of your personal and health information.
When you register with openDoctor, you will be asked to provide your name, birthday, email address, cell or mobile phone number and other information that we may request, all of which will become part of your Profile, and which you can add to or change from time to time. You will also be asked to select a user name and password which will serve to identify you as a Member each time you visit the Site and allow you to access your account. openDoctor may, from time to time, use the information you provide to us for, among other things, the purpose of communicating with you.
You grant us and all other persons or entities involved in the operation of this website the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of our website and in communication with you. We do not assume any responsibility or liability for any information you submit, or your or any other parties' use or misuse of information transmitted or received using our website's tools and services. Using the Services
This Site and the services offered by openDoctor through the Site (the "Services") are intended for your personal, noncommercial use in accordance with these TOS. You are responsible for all use of the Site and for all use of your user name, password and any other information you provide to openDoctor that relate to your access to the Site or your Profile ("Credentials"), including use by others to whom you have given your Credentials. You are responsible for keeping your password confidential and for notifying us if you become aware that your password has been hacked, stolen or known to others. You may notify us by clicking here. You may use the Site and the Services for lawful, non-commercial purposes only. You will not distribute or transmit any content or software or other computer files that contain a computer virus or other harmful component.
Changing the Services
We may from time to time add new services to the Services, substitute a new service for one of the existing Services, or discontinue or suspend one of the existing Services. Information about the new services will be included on the Site, and the users of new services will be governed by these TOS. You agree that openDoctor will not be liable to you or any third party for any suspension or discontinuation of any of the Services.

Proprietary Rights
The Site and all material published on the Site, including, but not limited to text, photographs, video, text, graphics, music, sounds, messages, comments, ratings, and other materials is owned by openDoctor or its licensors and is protected by copyright, patents, trademarks, trade secrets and/or other proprietary rights, including under the United States copyright laws. openDoctor owns a copyright in the selection, coordination, arrangement and enhancement of such content and a copyright in the Site.
All trademarks appearing on this Site ("Marks") are trademarks of their respective owners, including openDoctor and its partners. Users are prohibited from using any Marks without the written permission of openDoctor or such third party that may own the Marks.
Content on the Site is provided AS IS for your information and personal use only. You may not copy, publish, transmit, distribute, perform, sell, create derivative works of, or in any way exploit, any of the content, in whole or in part, without openDoctor prior written consent. You may download content for your personal, non-commercial use only as provided in these TOS, provided that you keep intact all copyright and other proprietary notices. Copying or storing of content for other than personal use is expressly prohibited without prior permission from us or the copyright holder identified in the copyright notice contained in the content.
Age Requirements
You must be 18 or over, or the legal age to form a binding contract in your jurisdiction if that age is greater than 18 years of age, to register with us or use the Site and the Services. If you are between the ages of 13 and 18 or the applicable legal age in your jurisdiction, you can use the Site or Services only in conjunction with, and under the supervision of, your parent or guardian who has agreed to the Terms of Service. Communications from openDoctor
If you use our sites and services, openDoctor may communicate with you via electronic message including email, text messages in accordance to our privacy policy. Message frequency varies per user. You can cancel this text message service at any time. Just reply to the text “STOP”. Message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.After you send the message “STOP” to us, we will send a reply message to confirm you have been unsubscribed. After this, you will no longer receive messages. If you want to join again, you can update your profile information to enable texts.

No Spam

You may not allow others to use your account to violate the terms of this section. We may terminate your membership or access to the Site immediately and take other legal action if you or anyone using your Credentials violates these provisions.

Termination
